Welcome to Potted

These Terms of Service ("Terms") govern your use of the Potted application and services ("Service") operated by Potted ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Potted is a plant tracking application that allows you to:

  • Track and manage your plants
  • Set care reminders and watering schedules
  • Keep journal entries about your plants
  • Upload and store photos of your plants
  • Sync your data across devices (with an account)

2. User Accounts

Account Creation

To access certain features of the Service, including cloud sync, you must create an account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account

Account Security

You are responsible for safeguarding your account. Notify us immediately at [email protected] if you suspect unauthorized access to your account.

3. Subscriptions and Payments

Free and Paid Tiers

Potted offers both free and paid subscription tiers. The free tier provides core functionality, while paid subscriptions unlock additional features.

Subscription Options

Potted Pro is available as an auto-renewable subscription with the following options:

  • Pro (1 Month) - Monthly subscription at $3.99 USD per month
  • Pro (1 Year) - Annual subscription at $24.99 USD per year

Prices may vary by region and are displayed in your local currency at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Billing

If you purchase a subscription:

  • You authorize us to charge your chosen payment method on a recurring basis
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Prices are subject to change with reasonable notice
  • All fees are non-refundable except as required by law or as expressly stated in these Terms

Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You retain access to paid features until the end of your current billing period
  • Your account reverts to the free tier after the billing period ends
  • Your data remains accessible, subject to free tier limitations

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service's operation
  • Use the Service to harass, abuse, or harm others
  • Use automated means to access the Service without permission
  • Reverse engineer or attempt to extract the source code of the Service

5. User Content

Your Content

You retain ownership of all content you create or upload to the Service ("User Content"), including plant information, journal entries, and photos. By using the Service, you grant us a limited license to store, process, and display your User Content solely to provide the Service to you.

Content Restrictions

You are solely responsible for your User Content. You agree not to upload content that:

  • Is illegal, harmful, or offensive
  • Infringes on intellectual property rights
  • Contains personal information of others without consent
  • Contains malware or malicious code

Content Privacy

All User Content is private by default and visible only to you. We do not share, sell, or publicly display your User Content.

6. Intellectual Property

Our Property

The Service, including its design, features, code, and branding, is owned by Potted and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or other brand features.

Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without obligation to you.

7. Termination

By You

You may terminate your account at any time by deleting it through the Service or contacting us. Upon termination:

  • You have 90 days to export your data
  • After 90 days, your data will be permanently deleted
  • Active subscriptions will not be refunded for partial billing periods

By Us

We may suspend or terminate your access to the Service if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees

We will provide reasonable notice before termination when possible, except in cases of serious violations.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • The Service will meet your specific requirements
  • Any plant care advice or information will be accurate or suitable for your plants

Potted is a tracking tool, not a source of professional horticultural advice. Always research the specific needs of your plants.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POTTED SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Any damages arising from your use or inability to use the Service
  • Any damages resulting from unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless Potted, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party

11. Dispute Resolution

Informal Resolution

Before filing a formal dispute, you agree to contact us at [email protected] to attempt to resolve the dispute informally.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Jurisdiction

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

12. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Potted regarding the Service.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights to any affiliate or successor.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Effective date" at the top
  • Sending an email notification for significant changes

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Auto-Renewable Subscription Terms

This section summarizes key information about Potted Pro subscriptions as required for App Store distribution:

  • Subscription Name: Potted Pro
  • Pro (1 Month): $3.99 USD per month, billed monthly
  • Pro (1 Year): $24.99 USD per year, billed annually
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Payment: Payment is charged to your Apple ID account at confirmation of purchase
  • Manage Subscriptions: You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions
  • Privacy Policy: View our Privacy Policy
  • Terms of Use: By subscribing, you agree to these Terms of Service

15. Apple App Store Terms

The following terms apply when you download and use the Potted application from the Apple App Store:

Agreement Between You and Potted

These Terms of Service constitute an agreement between you and Potted only, and not with Apple Inc. ("Apple"). Potted, not Apple, is solely responsible for the Potted application and its content.

License Grant

Subject to these Terms, Potted grants you a limited, non-exclusive, non-transferable license to use the Potted application on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the application on any device you do not own or control. You may not distribute or make the application available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, or sublicense the application. You may not copy (except as permitted by this license), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the application.

Maintenance and Support

Potted is solely responsible for providing maintenance and support services for the Potted application. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.

Warranty

Potted is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Potted's sole responsibility.

Product Claims

Potted, not Apple, is responsible for addressing any claims you or any third party may have relating to the Potted application or your possession and/or use of the application, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Claims

In the event of any third-party claim that the Potted application or your possession and use of the application infringes that third party's intellectual property rights, Potted, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms

You must comply with applicable third-party terms of agreement when using the Potted application (e.g., your wireless data service agreement).

Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms of Service, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
